What is my position on National Reciprocity? It has always been unequivocal and I firmly believe in Constitutional Carry first, Nationwide Reciprocity second (www.DeanBeersNRA.com/about-dean.html).
 
Just as states slowly moved from ‘may issue’ to ‘shall issue’ for issuing concealed carry permits, with a few remaining, we are seeing a similar trend in Constitutional Carry. Based on this, it seems practical on a national level that we will see National Reciprocity before National Constitutional Carry. I believe it will happen with our unified voices. Colorado, unfortunately, has repeatedly failed to pass a Constitutional Carry law. Perhaps it is time of a state constitutional amendment.

Holding a Colorado permit gives reciprocity to over 30 states. At one time that number was best achieved by also holding a Florida permit. There are states, such as Nevada, that make National Reciprocity – as an agreement between the states – impossible. This is unsafe for travelers and visitors, and I believe a violation of our 2nd Amendment Rights.
 
We saw federal law passed giving retired law enforcement National Reciprocity – something I have strongly supported. Removing the training and experience component, and with full respect of law enforcement, citizens should not be excluded from the same ability based on our 2nd Amendment Rights. In my personal opinion, the individual rights of both Constitutional Carry and Reciprocity – within each state and nationally – exists. However, I do not see the US Supreme Court hearing a case on this issue, at least without an attempt at federal legislation.
 
There is no reason for one state to not immediately recognize the carry permit of another state for those persons that are not residents.

If you believe in, and support your Bill of Rights – each and all of them – you believe in and support our 2nd Amendment. I firmly believe our Rights are for all to lawfully and responsibly exercise, or not, without interference from any person or entity.

I have been looking forward to this opportunity for over two years and am very excited to start the process and work hard for your support and for our rights. I firmly believe, as the NRA does, our right to 'keep and bear arms' is a right for all law-abiding citizens. This includes ending 'Gun Free Zones', expanding training opportunities, and national concealed carry reciprocity.

I come from a long family history of NRA members. I first joined some time before the age of 10; although a lapse in my membership, I have been a Life Member since late 2001. Both me and my Wife are proud Endowment Life Members.

I have been a proponent and advocate of responsible firearm ownership, safety and rights all of my life. I believe 'gun free zones' are the most dangerous places a person can be - whether in their hearts, minds or a physical location.

In 2013 I wrote a book about the history and direction of our Country. From there I decided that at some point, after other commitments, I would see what I could do to be part of the growing need to protect our freedoms as a civilian and Patriot. I presently have a book on our Second Amendment pending - it has been delayed and is being finished this summer - and will be announced here.


Who am I?
I am a husband, dad (stepdad), poppa, business owner, and Patriot. I am a firm believer in our Country and Freedoms. I firmly believe the NRA is the strongest and most important organization protecting our rights - not just our 2nd Amendment.

I firmly believe in each of our rights - individually and as a whole - they are unalienable.
It is our responsibility to support and defend them.

I am an independent fiscal conservative.  I firmly believe socialism (in any form or nomenclature) is un-Constitutional, un-American, and the most current threat to our freedoms - from personal to economic.

What is my experience?
I have been in business going on 30 years - since October 1987 - as a legal investigator, as well as an expert consultant.  With my Wife, we provide legal investigations and expert consultations in civil, criminal and probate litigation in personal injury, negligence and death.
 
I have been actively involved in professional associations since 2008 - from state associations to national and international associations. In these associations, I have served many functions, which have also prepared me for my desire to represent you on the NRA Board;
- Past VP of Membership and Board Chairman of our state association for our profession;
- Current committee membership for a renowned professional certification and also Chair of the legislative committee of the largest national association of our profession;
- Current Board Chairman, immediate Past President, past Vice President (3rd through 1st), past Secretary, and past Regional Director of the largest national association for federal legislative advocacy of our profession;
- Current Governor and past Ambassador of the largest international association of our profession; and
- Currently serve on other advisory boards and committees of specialized associations for our profession.
 
My strongest experiences are my experience with firearms, business owner, and serving our investigative profession through association boards and committees. This includes strong state and federal legislative and regulatory advocacy. I have spent nearly a decade in service to our profession and now I want to do the same for you on the NRA Board. I firmly believe I am the right person to be part of something greater - an honor.


Why the NRA and NRA Board?
For several years I have been greatly involved in several ways to further the best interests of our investigative and security professions.
 
I want to take that to the next level in being more, and significantly, involved in protecting our individual rights - as professional investigators and security officers, we have no significant voice on the board of the NRA. I want to be your voice.  Can I get your help with this?

Why now?
My involvement in associations of our investigative and security professions has been fulfilling. I have been very fortunate doing what I love. Now, its time to turn that to the rights I love. I owe the NRA for its nearly 140 history protecting our civil and 2nd Amendment rights.

I have written many times this election my first, or second, choice was not on the ballot – and my choice will never include any socialist candidate and will always be a fiscal and Constitutional conservative candidate. I’m not sure we have that, fully, in President-Elect Donald J. Trump. We do have faith that at least it will not get worse and will get better. With the other choices – it would have been eight more years of worse than the One Big Ass Mistake America made in 2008 and 2012 for that hopey changey thing that set us back a couple decades and tried to reverse our foundation and change the course of our future.
 
This election was about stopping the progressive / socialist movement – and it did with a majority (even if by one) of Congress (House and Senate), White House and with new US Supreme Court conservative justices the judicial branch. Having Congress and the White House has not happened since 1928.
 
Let’s be clear – it is not necessarily good for one ideology to control all branches of government; and our Founding Fathers warned us about this. However, the alternative was going to be the opposite – which would have derailed us into irreversible socialism. This fear was why I wrote my book, ‘Beers With Our Founding Fathers’. I was angry about the attacks on our 2nd Amendment – which is an attack on all our Bill of Rights. I was angry about the spending. I was angry that conservatives stayed home angry at the candidate on the ballot and stayed home or voted minor party. I was angry about the ramming of the first step of socialist healthcare – a planned failure that would be replaced with entirely government run (not just mandated and taxed) healthcare. I was angry about illegal immigration. I was angry about our war on terror – or lack thereof as we began seeing a growing number of domestic splinter attacks. Each of these are addressed in my book.  Each of these were addressed by candidate Trump; I was a supporter of Dr. Ben Carson. It is truly like I wrote the book as a guide for the next conservative candidate and he followed it – or has made campaign promises to.
 
After Carson and Cruz dropped, it took me a bit to come around to Trump, mostly because of his public persona. Then I started listening closely to those who opposed him and why. Then I started thinking about my book. Then I started thinking about my ideal candidate – an independent, business oriented, conservative who will look to our Bill of Rights and Constitution as his guide. Trump was a Democrat early on and for many years. I read his early books, and in recalling those remembered how influential they were to starting and staying in business (since 1987). In fact, I will go back and read them again.
 
Here's the take away - Bush and Clinton families are both done. The Republican party, which we abandoned many years ago, (GOP for Getting Obviously Progressive) has been shaken to its core and needs to abandon its elitist mentality. Socialism has been stopped and if the GOP commits to its responsibilities, and the attraction socialism will end in the younger generations - where it must. The people have spoken against the blatant corruption, criminality and established elitism.
 
Many don't realize it - but a 3rd party candidate was elected.  Another, Sanders, could have beat a fair - not corrupt - Clinton, and that's scary socialism is that popular. In fact, the 18-25 age group – the next serious group of parents and more active voters – overwhelmingly voted for socialism.

As to the first woman president - there are several better candidates ready to come forward - I look forward to that. She was the worst in many ways – as a person and politician.

“The progressive-socialist-democrats are experts at divide and conquer.  If race baiting doesn't work, its a war on women or some other social issue that is simply a distraction - but a dividing distraction.
 
If we all set aside personal agendas, and get only a slate of candidates that will support and defend the constitution, while furthering a conservative free market capitalist agenda (fiscal conservative) - we will have a Constitutional Conservative.
 
This whole 'compromise' thing is simply giving in.  The progressive-socialist-democrats are also experts at digging in their heels and not budging - so the GOP believes the progressive-socialist-democrats when they say 'if you want the [pick a minority or group] vote, you need to 'compromise' with us' and, sure enough, the progressive-socialist-democrats get what they always wanted - progress towards their goal and distancing conservatives from theirs.
 
The standard response (see below) of every Constitutional conservative, when asked about a personal and social issue, should be 'That is a personal social issue.  With the individual being the largest minority, our position is for the individual to address their personal needs and beliefs and for us to prosper by the fiscal conservative values of free market capitalism while supporting and defending our Constitution.'  I will guarantee success - continuing the path of the GOP is failure."
 
After this commentary, we saw the rise of the new Tea Party.  In my commentary about this I noted the following:
"The Tea Party is excoriated by the media as ultra-right-wing racists, etc.  Nothing could be further from the truth.  First, take a look back and see the direction our Country has consistently transitioned since the dawn of the 20th Century – left, ‘progressively’ left.  That leaves anything else as becoming more and more right.  Compared to the socialist / progressive agenda, yes, the Tea Party is far right. 
 
This is what Tea Party represents, and I stand behind it - most people do, they just are afraid to be labeled...
-- No more bailouts
-- Reduce the size and intrusiveness of government
-- Stop raising our taxes
-- Repeal Obamacare
-- Cease out-of-control spending
-- Bring back American prosperity
 
Do you agree or disagree with these concepts?  The alternative is socialism...
-- Nationalize consumer services
-- Increase the size and intrusiveness of government
-- Continue raising our taxes
-- Ignore failures of Obamacare
-- Ignore out-of-control spending
-- Lower socioeconomics over American Prosperity"

When you think of these, what do you think about? A candidate that could not win a third party vote, but as a successful business person worried about the direction of our country, had the financial means to risk it all and take on both parties - and did; in a sense - he risked what our Founding Fathers risked.

I look forward the next four years of establishing a strong foothold to end the progressive / socialist movement in America and to reunite the conservatives – whether it be a Republican party or replaced. Either way, it’s a new party and a correction to put us back to the future our Founding Fathers could not foresee, but laid the foundation for. 

I truly revere our Founding Fathers. They were not perfect, they did not necessarily like each other, and they did not agree on many things. However, they worked tirelessly to bring themselves together for a purpose greater than themselves. They were brought together by Divine intervention. My book makes a very important personal disclosure about me – I’m agnostic. Not atheist – big difference. My book details the history and importance of Judeo-Christianity in our culture and lives. Our Founding Fathers believed that Divine intervention brought them together to found a country based on our Natural rights. If you realize all the circumstances and history involved, you will come to realize there was a purpose for them and their resolve - and our own history is that product.
 
Whether you are atheist, agnostic, or otherwise spiritual - it is easy to see, and cannot be denied, the role that Christianity played in the birth and rise of our country.
 
Just as it is said Moses presented the 10 Commandments from God, I believe our Founding Fathers presented our Declaration of Independence and later our Bill of Rights (I still think symbolically and intentionally 10) in the same way and clearly tell us these rights are endowed upon us by our Creator.
 
When I realized what I had stated and published since 2013 as being what is necessary for the preservation of our country, as written on the back of my book it became clear that Trump was more than just the vote for the lesser of two evils, or against the other candidate – “Today our Country is faced with collapsing internally, with external forces also working against who we are.  It is not about political party, race, gender, sexual orientation, or other personal identification and social agenda used to prejudice others, class warfare.  It is about self-destruction.  Very simply, it is: Capitalism vs. Socialism / Judeo-Christianity vs. Radicals”.
 
It was a vote for what I have said in my book – which, apparently, I should have called ‘Make America Great Again’ - that is the goal of my book and President-Elect Trump.
 
We cannot predict success for our future – but we can predict failure; that failure was defeated. Now its time to put a full stop to the progressive / socialist agenda. That is why this election was important and the message – having control of all three branches of government – is clear.
 
I did come pretty close to predicting the election outcome. It wasn’t rocket science and I have never tried before.

What will be our future? I don't know. I do know its better simply for the defeat - not just of a candidate or candidates, but of a corrupt ideology in progressive / socialism. I hope its better for what I very passionately wrote about - day and night, for about 30 days for the draft (what started as a venting - a few pages - became hundreds of pages).  I wrote my book so our grandchildren would have something to see for our history; hoping they would not have to fight for it, but ready to if they should – “Seeing the history of our Country ignored – which is to ignore and destroy the future of our Children and Grandchildren.”

Why am I supporting Donald Trump? My first pick was Dr. Ben Carson, who received a personalized copy of my book with encouragement to run for our president.  Because I do believe Trump did not give up time, resources, business and money - during the campaign and as president - for nothing more than why he has said.  For the same reason I wrote my book - there is great concern for where our country will be after this election.  The choice is ours - not only in who will be president, but we are making choices for future generations.
 
My vote is not a party vote – I have been proudly unaffiliated for nearly three decades.  It is a Constitutional conservative and fiscal conservative vote – its defeating and ending the progressive / socialist agenda now and for good.  After Ben Carson and Ted Cruz dropped, there were no other candidates I trusted with my personal support and vote.  Finally, there is no third party vote – none. It’s a simple fact, and here is why…
 
Historically, conservatives get mad at our final choices for candidates and stay home instead of voting.  Demoncrats will vote for their candidate, no matter the choice or character of the candidate – especially if they will 'be part of history'.  Ultimately it comes down to one question – what future do you want for our nation – and you have two choices.  It’s time to pull up your pants, pull up your boots, dust them off and vote.  Some say we do have choices – Libertarian and others – 3rd party.  Sure, but they simply do not count after the primaries – and barely during the primaries.  Ultimately, Donald Trump fits my profile of a candidate in previous commentary, to grow a new party from the Getting Obviously Progressive (GOP) party – “Freedom Party - Advice from a Patriot” (originally posted 6/30/2013) at  www.beerswithourfoundingfathers.com/blog---author-thoughts/freedom-party-advice-from-a-patriot).
 
In my book, ‘Beers With Our Founding Fathers’, I discuss the Electoral College – a Constitutional compromise that prevented those in power – Congress – from electing our President and Vice President, while giving the People the important right to vote.
 
“The Electoral College is the Constitutional manner in which the president and vice president are elected based on state delegates (Republic).  Each state has a number of electors equal to their congressional representatives (two senators and representatives based on population).  These delegates cast their votes based on their state law – either all votes to the candidate winning the majority of the popular vote in that state; or apportioned to the candidates based on their proportion of the popular votes.”
 
The Electoral College is comprised of the same number of Senators and Representatives for each state and Washington DC – 538 in total; US territories do not have a vote in the general presidential or Congressional elections, and therefore no votes in the Electoral College.  US territories do hold primary elections and send delegates to the party convention for nominations.
 
Think of the Electoral College as proxy voting - a group of people sending their votes to a single proxy voter, who will cast their vote as directed by the popular vote of their constituents.  In the Electoral College, 270 votes are needed by a presidential candidate to win the election – which may follow the popular vote, or not (in the George W. Bush / Al Gore election – Bush won the Electoral College to Gore’s winning the popular vote).  How the votes in the Electoral College are apportioned to the candidates depends on state law.  In every state, except Maine and Nebraska, it is a winner take all the Electoral College votes, based on the popular vote.  In Maine and Nebraska they may be apportioned  - but never have been, also a winner-take-all. Every popular vote is counted – or not – differently.  The largest state, California with 55 Electoral College votes, is a significant win or loss to a candidate – but the smaller ‘battle ground’ states can make the difference.
 
How important is this to the current election cycle – ideologically the most important of the 20th and 21st centuries? As I have noted in my book, the president is NOT the most important vote – in reality it is the vote for Congress – Representatives and Senators – because you do directly vote and the totality of the votes are what creates law and affirms the higher court judges that interpret and rule on the law.  In our Constitution, the three branches are separate but equal – checks and balances.  Yes, it is important – it is not the only or most important.  It is the most important because the next president will pick perhaps more than half of the current US Supreme Court replacements – and will be affirmed by the new Senate.  Both of which must have a conservative – as president and in the majority.  It is important because we need a fiscal conservative government, or at least the makings of a new one, to steer us from the fatal course we have been put on the last eight years.  The current president has had us on the edge of a cliff – the next will either push us over or pull us back.  The choice is ours – YOURS! The only reason Hilly is known, and even a candidate, today is because 3rd party votes for Ross Perot (in the George HW Bush / Bill Clinton election and Bill Clinton won as a result. I won't make that mistake twice. Neither should you - unless you want Hilly to win. Even if you considered Libertarian as viable - Johnson has turned into an economic socialist. Perot was a free market capitalist.  The only way a 3rd party is viable to win is if they can attain over 1/3 of the popular vote during the primaries – after the primaries, 3rd party is non-existent.  George W Bush lost the majority vote to Al Gore – in part also because of the 3rd party candidate – Ralph Nader; the Electoral College kept Al Gore out of office.
 
Historically, those voting 3rd party would be more inclined to vote GOP and not inclined to vote demoncrat. Based on some states that lost the GOP popular vote and winner takes all to the demoncrats - that's how Ross Perot gave us Clinton the First; and angry GOP and 3rd party will give us Clinton II. It's not winning a state in the Electoral College vote - it's losing.
 
The problem is protest votes are like not voting. 3rd party is like not voting. It's because of the Electoral College. In the Electoral College only the votes of states and DC count - no territories. Electoral College votes are winner take all, except Maine and Nebraska, which may split the votes based on the popular vote - for realistic purposes - a 3rd party could get one vote from each of these (which could - unlikely but... - send the election to Congress, as close as this race is).
 
Continuing - that makes it a two party system - it doesn't matter how we feel about that; just reality. A protest vote is essentially not voting to be counted. It is predicted that Maine could be a deciding state with such a predicted EC situation.
 
Continuing - In Colorado it is close enough Trump is predicted to win - but if he doesn't that is a loss of our nine Electoral College votes to Clinton. If the undecideds / protests vote 3rd party it is a historic fact that the demoncrats will vote their party. It is also a historic fact the mad GOP stay home or vote 3rd party...give such respective states their full Electoral College votes - no matter the ratio of popular vote.
 
To conclude - YES - it is a waste to not vote, protest vote or 3rd party vote. This can only change if a good enough 3rd party candidate runs. In reality that is what Donald Trump and Bernie Sanders did - they were not previously of their respective parties. Hilly had to rig the primaries to beat Sanders – pathetic. Trump beat out 16 others, including my top three choices.
 
I understand the protest votes...but having Hilly is simply the worst of worst case scenarios. She could win with barely 1/3. My vote is against her. The real issue is the Electoral College – which is essentially forced to ignore 3rd party votes by most state rules (and in a few – Johnson could get allocated valuable Electoral College votes, giving it to Hilly).
 
So, what happens if no candidate gets 270 – and we know a 3rd party candidate cannot get 270?
 
"Our Constitution provides if no candidate receives a majority of Electoral votes, the House of Representatives elects the President from the three Presidential candidates who received the most Electoral votes. Each state delegation has one vote. The Senate would elect the Vice President from the two Vice Presidential candidates with the most Electoral votes. Each Senator would cast one vote for Vice President. If the House of Representatives fails to elect a President by Inauguration Day, the Vice-President Elect serves as acting President until the deadlock is resolved in the House.  Current 3rd party candidate Gary Johnson has this goal in mind – and it is statistically possible – however, very unlikely in Congress.  Congress will not want a split ticket or a 3rd party president – its that simple."  What does this mean?  Well, because the candidates Congress would vote on come from those receiving Electoral votes - and currently there is essentially zero possibility of any minor party candidate getting one Electoral vote - Congress will have two choices for president.  Its a false belief that a minor party candidate has a chance if the election goes to Congress.
 
As a candidate from the outside and who I think can restore pride in America again - I do support Trump.  For those that do not and still wish for another candidate - we have two choices – no wishing or wanting helps.  I want a candidate that is bucking the Getting Obviously Progressive party – I want a Freedom Party style candidate, such as Trump (www.beerswithourfoundingfathers.com/blog---author-thoughts/freedom-party-advice-from-a-patriot).  If you are opposed to Trump simply because he was not your choice - think of what my Dad used to say – shit in one hand and want/wish in the other and see which one gets fuller faster.  Well, I’m not shitting in my hands – I’m voting and it will be to target that Hilly Clinton is not elected to push us over the cliff.

It is time to end the Progressive / Socialist agenda, once and for all, now - and it begins with stopping Hilly now. If not, 16 years of socialism is unacceptable and is not the future of our grandchildren and great grandchildren I intend to let happen.

“Since my civics class in ninth grade, I realized that the worst candidate for president is often the most common candidate for president.  For the states, it also applies to governors.  First, how about two criteria:  1) Experience; and 2) Economy.  Add to this – never, ever – ever – vote for a candidate that is a sitting Representative or Senator.  And do not forget – promises are only emotional rhetoric. 
 
The president does not enact legislation (Constitutionally speaking, that is).  They may steer and propose legislation and budgets, but they cannot keep the promises they make without the cooperation of the legislative branch.  More important, as a sitting member of Congress they do have the authorities to introduce legislation.  The question is, if they could not get their legislation introduced or passed while in Congress, how will they do so as president? 
 
Historically, from the mid twentieth century, only two presidents were sitting Senators (no Representatives) when they were elected to office.  Although of the same party, their ideologies were not similar.  The first was assassinated in office, and the second was somehow re-elected on a socialist agenda of taxpayer funded unearned handouts, divisive class warfare, and a growing polarity within our Country – all during a continuing economy that has at best flat lined.  The reason is simple – he was not re-elected on job performance, but charismatic emotional rhetorical promises – also known incorrectly as entitlements and is really unearned taxpayer funded government handouts indoctrinated by the Parasitic Cult.  It has become a morbid – and troubling – state of our Country.  The economy is both the key to, and result of, our sacred birthright freedoms.  Control a person’s wallet and you will control their freedom.  Follow the money as they say.”
 
Your Vote Counts in Congress

A short lesson on Congress and party majority is important (it’s the one time I agree with party trumps platform).  The majority party elects the leader of the Congressional body – Senate Majority Leader and Speaker of the House (also third in line for presidency).  Those leaders appoint committee chairs from their majority party and the committees become a majority of that party.  Those leaders also direct legislation and agendas.  It is why you have seen no impeachment proceedings and spineless reaction to the demands of a president.  There is no longer a check of the Executive branch by the Legislative branch.  It’s the teenager ruling the parent (not the best analogy – there is no equality of power and privilege between parents and children).
 
Why is your vote for members of Congress so important?  Simply because at the state level your vote may determine who becomes a majority leader and committee chair.  The 2014 mid-term election was defining, as it needed to be.  Then nothing changed, except a new Senate majority and leader.  The Senate Majority Leader was re-elected from Kentucky on a history of caving to the president.  The incoming Speaker of the House was re-elected from Ohio, also on a history of caving to the president.  He went on to be re-elected as Speaker because, having won the majority party in the 2012 elections, they wanted to keep their committee appointments and being chairpersons.  In 1996 was a Congressional revolution similar to 2012 and 2014 – but things changed.  The Legislative branch and Executive branch had to exercise their Constitutionally limited powers.  I was not a fan of that presidential administration.  I will say that the economy continued to improve and racial tensions continued to subside.  Public assistance was not an entitlement, but a necessity with benefits and responsibilities.  However, don’t think for one minute that his wife – a failed Senator and Secretary of State, and candidate to be a ‘first’ – woman president – would be the same.  Her college thesis was based on a socialist and his teachings.  But, I digressed.
 
Never again say your vote does not count, particularly in your state.  Our three branches of government are now concurrently running amok.  They do so because the ultimate check and balance – the voter – is not doing their job.  In the 2014 elections voters in many states turned over to a new candidate – that is what turned the Senate.  But, Kentucky voted for an incumbent that had developed a progressive leaning track record.  Had Kentucky and Ohio both voted for a stronger conservative new candidate over their incumbent, Congress would have different leadership and, hopefully, empowered to challenge the Executive branch as our Constitution requires.
 
Next time you are at the voting booth – vote strongly for your local and Congressional candidates.  Your vote does count.

What Did Director Comey Really Tell Us?
Yesterday we all saw, or heard, the breaking news of FBI Director Comey’s detailed press conference and text of the press release.  That is the key – detailed.  As a legal investigator for a living of nearly 30 years, I review and dissect statements daily – because the facts are in the details.  What most people heard was ‘no charges’; more accurately it was no recommendation of charges, but I’ll get to that.

You can read my minimal comments and the relevant text, exactly quoted, of Director Comey’s speech here - www.beerswithourfoundingfathers.com/blog---author-thoughts/unfit-to-run-for-or-be-president.  I also detailed three specific quotes:

 - "There is evidence that they were extremely careless in their handling of very sensitive, highly classified information."

- "There is evidence of potential violations of the statutes regarding the handling of classified information."

- My favorite, "This is not to suggest that in similar circumstances, a person who engaged in this activity would face no consequences. Those individuals are often subject to security or administrative sanctions."

 However, the most important quotes are these, which are not in my emotional response:

- “…the FBI is completing its investigation and referring the case to the Department of Justice for a prosecutive decision.”

- This will be an unusual statement in at least a couple ways.

       -- First, I am going to include more detail about our process than I ordinarily would, because I think the American people deserve those details in a case of intense public interest.
        -- Second, I have not coordinated or reviewed this statement in any way with the Department of Justice or any other part of the government. They do not know what I am about to say.

Then Director Comey went on the lay the case out before the American people in a public forum in which he could not be stopped or censored.  He continued, with every listener expecting him to close with recommending her indictment.  He did not – and it left everyone stunned; from supporters to opponents.  Who was not stunned were those that all variously met in the week leading up to this press conference.
Why would Director Comey do this?  First, he knew there would be no charges – because the Attorney General had said, only a few days before, that she “fully expects to accept the recommendations” of the FBI investigations.  He responded to her wiggle room with his own – here is the case of the FBI, which you do not want us to report; and here is the recommendation you wanted.  I do not think he was ordered to; pressured yes.  What do the above details mean?
“…the FBI is completing its investigation and referring the case to the Department of Justice for a prosecutive decision.”
I am a published author and recognized expert in the process of private investigations.  One of my mantra’s is to COMPLETE the investigation, not just conduct.  He was clearly telling the American people the investigation was not complete.  The timeline he was under left him no ability to announced any conclusions after completing the investigation.  The president was leaving that morning with the subject of the investigation to campaign – and she needed ‘cleared’ first.
He concluded this statement by making it clear that he was tossing the ball into the AG’s court.
- This will be an unusual statement in at least a couple ways. In other words, get ready and take careful notes.

Again, get ready and take careful notes – I’m about to tell you things you would not otherwise hear.  I am about to tell the American people that they have an important decision to make and the information I am going to detail should help in that decision.
     -- Second, I have not coordinated or reviewed this statement in any way with the Department of Justice or any other part of the government. They do not know what I am about to say. Due to circumstances beyond my control, and undue pressure, I am about to throw myself under the bus – but I am at least going to do all I can to keep control of the circumstances.  I may have been pressured to announce a pre-determined outcome, but I will not be pressured into lying to the American people.

Unfit to Run For or Be President

This is hot off the press after the announcement of FBI Director Comey to not recommend charges against democratic presidential candidate, and former Secretary of State, Hillary Clinton.

This is not about guilt or innocence, as a legal investigator professionally, that is a concern.  This is about the appearance of impropriety and founded acts unfit for a Secretary of State or President.

- Thursday 06/09/2016 - President Obama announces formal endorsement of Hillary Clinton.

- Monday 06/27/2016 - Bill Clinton just happened to learn the AG was on the AZ tarmac and waited so he could spontaneously board her government plane and chat about grandkids for 30 minutes.  She happened to divert from a trip to Aspen to Arizona. The AG and her staff in advance knew there was possibility of impropriety by either or both.

- Friday 07/01/2016 - AG announced meeting may have been inappropriate and would not interfere with the ongoing FBI investigation of Hillary Clinton.  She stated, she 'fully expects to accept the recommendations'.

- Sunday 07/02/2016 - Multiple FBI agents meet Hillary Clinton at her home (not nearby FBI headquarters or any other FBI office) and interview her for over three hours.

- Tuesday 07/05/2016 - it is announced that President Obama will be campaigning with Hillary Clinton and she will be flying on Air Force One.

- Tuesday 07/05/2016 - FBI Director Comey announces a litany of violations found in the investigation (below) and recommends to the Department of Justice that no charges be filed.

He may not have recommended criminal charges; however, he did lay out a clear list of violations which clearly show she is unfit to run for or be our president - and should have been charged with.

  • FBI’s investigation of Secretary Clinton’s use of a personal e-mail system during her time as Secretary of State.
    • Secretary Clinton used several different servers and administrators of those servers during her four years at the State Department, and used numerous mobile devices to view and send e-mail on that personal domain.
    • As new servers and equipment were employed, older servers were taken out of service, stored, and decommissioned in various ways.
      • When one of Secretary Clinton’s original personal servers was decommissioned in 2013, the e-mail software was removed.
    • From the group of 30,000 e-mails returned to the State Department:
      • 110 e-mails in 52 e-mail chains have been determined by the owning agency to contain classified information at the time they were sent or received.
      • Eight of those chains contained information that was Top Secret at the time they were sent
      • 36 chains contained Secret information at the time; and eight contained Confidential information
      • Separate from those, about 2,000 additional e-mails were “up-classified” to make them Confidential
    • The FBI also discovered several thousand work-related e-mails that were not in the group of 30,000 that were returned by Secretary Clinton to State in 2014.
      • Three of those were classified at the time they were sent or received
      • One at the Secret level and two at the Confidential level.
    • Found no evidence that any of the additional work-related e-mails were intentionally deleted in an effort to conceal them.
    • It is also likely that there are other work-related e-mails that they did not produce to State and that we did not find elsewhere, and that are now gone because they deleted all e-mails they did not return to State, and the lawyers cleaned their devices in such a way as to preclude complete forensic recovery.
 
  • Did not find clear evidence that Secretary Clinton or her colleagues intended to violate laws governing the handling of classified information
  • There is evidence that they were extremely careless in their handling of very sensitive, highly classified information.
    • Seven e-mail chains concern matters that were classified at the Top Secret/Special Access Program level when they were sent and received.
  • There is evidence to support a conclusion that any reasonable person in Secretary Clinton’s position, or in the position of those government employees with whom she was corresponding about these matters, should have known that an unclassified system was no place for that conversation.
    • Information that was properly classified as Secret by the U.S. Intelligence Community at the time it was discussed on e-mail (that is, excluding the later “up-classified” e-mails).
    • None of these e-mails should have been on any kind of unclassified system, but their presence is especially concerning.
    • Even if information is not marked “classified” in an e-mail, participants who know or should know that the subject matter is classified are still obligated to protect it.
  • Hostile actors gained access to the private commercial e-mail accounts of people with whom Secretary Clinton was in regular contact from her personal account.
  • Secretary Clinton’s use of a personal e-mail domain was both known by a large number of people and readily apparent.
  • It is possible that hostile actors gained access to Secretary Clinton’s personal e-mail account.
 
  • There is evidence of potential violations of the statutes regarding the handling of classified information
  • This is not to suggest that in similar circumstances, a person who engaged in this activity would face no consequences. Those individuals are often subject to security or administrative sanctions.
The indictment Hilly needs is from the American voters - no vote for her. There cannot be a stronger indictment.

Presidential Election 2016 - Socialism or Freedom

This is my first commentary since November 2014 - hard to believe I did not post anything in all of 2015.  There was simply too much to really focus commentary on.  This will make up for it, I promise.

Presidential Election of 2016 - Socialism (really Communism) or Freedom?

On 01/05/2014 I wrote a very short blog on the importance of the November 2014 mid-term elections for Congress – 2014 Year of Reclamation (www.beerswithourfoundingfathers.com/blog---author-thoughts/2014-year-of-reclamation) to underscore the importance of conservatives winning the majority of both houses of Congress to prevent the loss of our Country to socialism. 
 
     Just over one year ago I wrote the following words to begin my book, “Today our Country is faced with collapsing internally, with external forces also working against who we are.”  Since that time, there has been enough scandal, fraud and danger to write another.
 
     How do we correct the course and direction of our Country?  We must begin at home, with our children.  Indoctrination begins in the schools – federally funded and regulated public schools.  The 2014 elections are the most important of our lifetime.  This is where we can prevent the collapse that will continue with the 2016 elections – between the current socialist agenda and the Getting Obviously Progressive (GOP) capitulation, we are well on our way to fulfilling the goals of the Progressives only 100 years ago.  How important is 2014 in defeating Socialism?

We won, but we lost with pathetic leadership. The 2016 elections are for our president, 1/3 of the Senate and all of the House of Representatives.  Your state congressional elections are the most important, but this commentary is about our presidential elections.  Use the same criteria locally for all of your elections.  Failing to elect the right leadership and holding them accountable is tantamount to surrendering to socialism and surrendering our freedoms – all of our freedoms.
 
It seems many of the current Republican candidates are less Getting Obviously Progressive (GOP) and more conservative; some certainly more than others.  Marco Rubio simply is not one of them…he burned that bridge when he became part of the Gang of 8 and the likes of Schumer, McCain and Graham (the Three Stooges).  Ted Cruz is also in the top three – but like Marco Rubio, he is also a sitting Senator – as is former candidate Rand Paul; and other current or former Senators and Representatives that have dropped.  My first rule, as noted in my book, is to not vote for a currently (or recently) sitting Senator or Representative.  Why?  Simply – they are or were in a position to at least introduce legislation to accomplish what they now promise to do if elected.  Empty promises – all of them.  The president does not have the power to cut agencies, eliminate the IRS, cut the budget, and so on; unless you contravene our Constitution, which has been done by our current president.  Most importantly, Congress holds the power of the purse – they can cut agencies, cut spending, cut the budget, cut the budget of agencies, and so on.  Sure, there have been a few that have introduced some legislation, but their records – especially their voting records – simply does not support their statements.  It is important to note this after the Republicans have gained a majority in both the Senate and House of Representatives (Congress) nothing changed – in fact, much got worse.  You should look at current and former governors the very same way in how they lead their state.
 
I have always supported Ben Carson – I sent him a copy of my book asking him to run.  In fairness, I also personally left a copy for Ted Cruz and Rand Paul at their Senate offices (all in 2013, immediately after my book was released). Dr. Carson has the intelligence and leadership - and he is not party of the system.
 
Endorsements mean absolutely nothing to me – for or against, agree or disagree.  Each person should do their own research of candidates and platforms, fact or fiction.  Perhaps its my lifelong investigative nature that keeps me unbiased and only interested in the facts I find.  Its voting intellectually and not emotionally.
 
Being perpetually uninformed, because you choose to be, is something I will never understand. Don't rely on what others say (or post in print or in social media). Agree or disagree on an issue...do your own independent research. I would say this is my investigative instincts, but it is not. It is how I was raised and taught...back to grabbing a dictionary to learn how to spell, pronounce or use a word properly.
 
As an example...if you disagree with a 'fact' presented by someone, why trust them to provide proof? How about proving or disproving it yourself.
 
In civil and criminal cases we never take the 'facts' as given to us to be so...we set out to make that determination ourselves. Otherwise, we are a disservice to our clients.
 
Don't be a disservice to yourself.
 
Let’s talk about socialism at this point.  Socialism is a form of control through economics. It's not freedom, it's indentured servitude. Socialism is our enemy. You cannot support both socialism and freedom...it's oxymoronic.  I 110% unequivocally feel this way. It is simply UN-American in every way. Go to where it is already a failure and let us return to our principles of historical success.  Here is a real-life example that just happened in my home town…a capitalist test turned socialist solution.
 
     In northern Colorado a fast food restaurant franchise announced a franchise test on wages. When they first announced its test to raise the entry-level minimum wage, I knew it would be a success - its the basic principles we were all taught growing up in my generation of the 70s and 80s. Something that has been lost in the last two decades and continues to reverberate in this election season.  The test was about responsibility and accountability – not missing days, not being late, finding a replacement for days off, etc.
 
     However, when the restaurant announced that with the success of the program would come raises for all employees in all the franchise stores in Colorado, I was lost. Those pilot test employees earned their raise - and, if as reported, apparently earned it for everyone else who did nothing for it. Perhaps the full intent of the restaurant and their revised policy was not fully reported.
 
     The program, as published, was about responsibility and accountability - earning the raise; much like respect is mutually earned and given. Those employees should be very proud.
 
     All businesses would do well to return to what the restaurant proved: giving employees accountability and responsibility will earn them the respect of their employers in the form of a raise. This used to be the standard: entry-level wage, an evaluation of accountability and responsibility in regular intervals (90 days, six months, one year, etc.) and a raise to go with it. Society has now turned to giving annual merit raises across the board - formerly cost of living raises - and nothing else; perhaps a gratuitous evaluation - but no raise to go with a positive evaluation.
 
     My high school job was as a sacker at a small family run grocer. High school students wanted the job because it paid more than minimum wage ($3.50 vs $3.35) and after each 90 days we could get a .25 raise - up to $4.25! Not much in today's standards, but when someone sat at $3.50 and others passed them at $4.25 and then promotions, it meant something. With hard work came the rewards of raises and promotions that could become careers or stepping stones to higher education and careers; perhaps, like myself - business ownership.
 
     Isn't it time we took what the restaurant PROVED and return to that very example? Hopefully there is some misreporting and the restaurant will require all employees to demonstrate responsibility and accountability for their own raises. If not, its simply a program of a few working hard so that everyone can get a raise.
 
What are my criteria for the right candidate for president?  Its simple – a Constitutional Conservative.  From an earlier blog post, Freedom Party - Advice from a Patriot (originally posted 06/30/2013 at www.beerswithourfoundingfathers.com/blog---author-thoughts/freedom-party-advice-from-a-patriot).  Our president is meant to lead and present to Congress what is necessary to do so.  Each branch of government being mutually beneficial in doing so, while adhering to the checks and balances required of them.
 
     The progressive-socialist-democrats are experts at divide and conquer.  If race baiting doesn't work, its a war on women or some other social issue that is simply a distraction - but a dividing distraction.
 
     If we all set aside personal agendas, and get only a slate of candidates that will support and defend the Constitution, while furthering a conservative free market capitalist agenda (fiscal conservative) - we will have a Constitutional Conservative.
 
     This whole 'compromise' thing is simply giving in.  The progressive-socialist-democrats are also experts at digging in their heels and not budging - so the GOP believes the progressive-socialist-democrats when they say 'if you want the [pick a minority or group] vote, you need to 'compromise' with us' and, sure enough, the progressive-socialist-democrats get what they always wanted - progress towards their goal and distancing conservatives from theirs.
 
     The standard response of every Constitutional conservative, when asked about a personal and social issue, should be 'That is a personal social issue.  With the individual being the largest minority, our position is for the individual to address their personal needs and beliefs and for us to prosper by the fiscal conservative values of free market capitalism while supporting and defending our Constitution.'  I will guarantee success - continuing the path of the GOP (Getting Obviously Progressive) is failure.
     1. Candidates need only to keep two key issues:  a) Constitutional Freedoms; and b) Fiscal Freedom.
     -- Constitutional Freedoms:  If it is not defined in our Freedom Documents, it is essentially irrelevant and up to the sovereign states and sovereign People.  Social issues are divisive and the GOP fails to accept that the Democrats will continue to use these issues against the GOP.  More important, internally they are destructive to the party. 
     -- Fiscal Freedom:  If it is not a free market capitalist issue and solution, it is essentially irrelevant.  The economy is not a ‘trickle down’ – it is a continuous circle, emanating from the center and rippling out.  It is socialism that breaks this continuum.
     2. Return to the core principles that founded this Country.  The new party – Freedom Party – should truly be founded on the principles of our Declaration of Independence and supported by our Constitution.  The Anti-Federalists, such as Thomas Jefferson, warned of issues and events that have slowly emerged in the 19th & 20th centuries, coming to fruition in the current century. 

The socialist candidates, and those pandering to be on the ticket or in the cabinet, are calling for the interest rates of student loans to be reduced.  If Wall Street can borrow money at 2%, so can college students.  Well, Congress took Wall Street (banks) out of the picture.  The government borrows from Wall Street (and China, but that’s yet another analysis).  What happened?  Under ObamaCare the feds took student loans from banks (formerly government guaranteed loans) and made them government loans only - and set the interest rate at 7%. Its the only for-profit program the government openly has, for now. It was one of those things (then House Speaker) Nancy Pelosi said we had to pass to see what was in it.  What was in it?
 
     The federal government borrows the funds for the student loan program at 2.8 percent and then lends it to the students at 6.8 percent, a markup of 4 percent.
 
     When the health-care law was passed in 2010, Democrats slipped in massive changes to student-loan programs, essentially cutting banks out of the business. In the official analysis of the health-care bill by the Congressional Budget Office, ending federal guarantees for federal loans and replacing them with direct loans made by the Education Department would yield $58 billion between 2010 and 2019.
 
     All federal money is fungible, but with such a large pot of money suddenly (theoretically) available, Congress wanted to spend it on other things. Here’s the breakdown of where the money went:
 
  - $36 billion on increases in Pell college grants for low-income students.
  - $10.3 billion for deficit reduction.
  - $8.7 billion to support the health care law.
  - $3 billion for historically black colleges and minority-serving institutions.
 
What else was in it for taxes?  In 2013 the following tax increases, all introduced and voted for in ObamaCare by the socialists.  As I mentioned in my book and book blog commentaries on healthcare reform (www.beerswithourfoundingfathers.com/blog---author-thoughts/nationalized-healthcare-nobamacare-a-better-solution and http://www.beerswithourfoundingfathers.com/blog---author-thoughts/the-affordable-care-act-is-bad-medicine, ObamaCare is about economic control and a new source of revenue – it has never been about healthcare.  Here is some of the revenue as of 2013:
  - Top Income Tax bracket went from 35% to 39.6%
  - Top Income Payroll Tax went from 37.4% to 52.2%
  - Capital Gains Tax went from 15% to 28%
  - Dividend Tax went from 15% to 39.6%
  - Estate Tax went from 0% to 55%
 
The list is too long, but here is a link - http://obamacarefacts.com/obamacare-taxes.  Never vote for a democrat – it is voting for a socialist.  The GOP continues in its efforts at Getting Obviously Progressive, but We the People can fix that – it is our right, our duty and our responsibility.

     Sometimes I wonder if it would be better to be in the Cold War (figuratively). During that time we knew our enemy, feared mutually assured destruction, knew and fought socialism and communism, we were an economic and military super power, had a much lower debt and stronger economy, and never condoned the level of corruption and tyranny we have this century.
 
     Its not that all was good - and I truly would not want to revisit that time - just the elements I described.  Perhaps we are now facing unintended consequences - we now have selfish pigs excited about supporting socialism for their selfish greed at the cost of so much beyond money.
 
     It sickens me a great deal that we fought and overcame one of the greatest military superpowers, using economics – communism – that so many fought and also died to prevent spreading...to have so many want such selfishness and to lose their rights. Now we have the economic terrorism of communism taking root with socialism, and also islamic jihadist terrorism firmly planted and growing. Simply sickening and disgusting. I would have never thought, while growing up, we would witness such self-destruction.
 
     Obama has been a puppet - as would be Bernie, but Clinton would be the stroke of evil we could not recover from.
 
     Our enemy has always been socialism - dating back to the days of empires and serfs.
 
The latest buzzword, because of the socialist Sanders running, is 'democratic socialist'.  For all those confused about 'democratic socialism' and 'socialism'...its socialism. You can chop it up and put it back together any way you want...its socialism. Socialism is communism. Why? Because the government owns production. EU is a democratic socialist block of socialist countries - just as the old Union of Soviet Socialist Republics was. They are both 'socialist democrat' in government/economics. We aren't the EU or the USSR...we are the USA, a democratic republic. That's not subject to change under our Constitution. Get over it and move on.Socialism (communism) - government holds the power and economy.
Republic - the people hold the power and economy.

We are losing our republic and its time We the People stood up for what we are and believe in. That includes standing firmly against socialism - there is no compromise.

Immigration Reform is a Legislative Branch Issue
Immigration is not a political issue.  It is a Constitutional issue.  Its an Inconvenient Hypocrisy.
Updated 11/25/2014 - from a speech today, the president had this to say in response to hecklers that he has not done enough - "
What you're not paying attention to is the fact that I just took an action to change the law, so that's point No. 1," Obama said. "Point No. 2, the way the change in the law works is that we're reprioritizing how we enforce our immigration laws generally."

The problem of fixing immigration laws is an Inconvenient Hypocrisy.  Every solution for decades has dealt only with illegal immigration and quick fixes, not the legal immigration issues.  Here are the most common problems and rhetoric of immigration reform:
  • Facts and rhetoric – illegal or legal immigration problems and solutions;
  • Unconstitutional executive action bypassing legislative action and our Constitution;
  • History of both executive and legislative actions have only exacerbated the problem;
  • The need for laborers that Americans won’t do;
  • Fracturing families and deportation is not a solution; and
  • Families wanting a better life and children want to go to college and can’t.

The first issue to deal with is simple - Facts and rhetoric – illegal or legal immigration problems and solutions.  There are only two issues, one more complicated than the other.  The first is illegal immigration and the solution is to enforce the current laws and deport all illegal aliens as soon as that determination is made.  No delay.  The second is legal immigration and the solution is complicated because the problem is complicated immigration procedures and laws.  Politicians avoid the latter and focus on the former because it is an emotional issue and voters follow emotional issues.

President Obama signs an executive order bypassing our Constitution and Congress, essentially creating new law and amending current law.  This is not immigration reform.  Immigration reform fixes those issues that hinder legal immigration.  Immigration reform is not about illegal immigration – that is resolved by enforcement and deportation.  If our government can accept them by the tens of thousands per month, they can deport them faster.

These new executive orders give a reprieve to groups of illegal immigrants, but does nothing to help those here legally and struggling with a process filled with red tape and thousands of dollars.  I know some found proud naturalized citizens.  This offends legal immigration and those struggling with it. It has a huge social cost impact. It violates our Constitution...and that, for anyone in support of it and opposed to government abuse of it, should be enough to also be offended. When they attack our Constitution, they attack this and will subvert our rights. See the Patriot Act.

Fixing the problem for legal entry is the point. Now all those doing so legally have been bypassed in favor of amnesty in violation of our Constitution. No one should be in favor of a president acting around our Constitution to influence action by Congress. That has been my position for over 30 years and will always be. Fix the process of legal entry. In 30 years it has mostly been a democratic Congress and presidents in favor of fixing (not reform, etc.). The answer is not made by usurping our Constitution as an attempt to force a lame duck Congress to take the action they could have (and at the time - had Sen. Cruz, Sen. McCain and Sen. Graham on board with Sen. Schumer).

Reagan, and others, did so with Congress - not against (and - I opposed all). Fix what is broken - what is broken is the process of legal entry and residency to naturalization. This is only the first of several steps he intends to take by the end of the year. A little here, a little there, seems harmless. It is how the Patriot Act came to be what it is (in full disclosure – I supported the originally drafted, but not passed Patriot Act) - an out of control Department of Homeland Security and domestic citizen spying, etc. No trust in government – and no trust in one person (any person) doing so unilaterally. There is a reason we have three branches of government. For me this is about the process and then about the content. There is no justification for usurping our Constitution, none, regardless of the circumstances. To do so only allows the erosion of the checks and balances, our rights, and the very foundation.

Let’s look at the common emotional rhetoric – because people will not accept facts and reality.
  • They are doing the jobs that Americans won’t do!  Non-sense. We have had legal migrant farm workers for years, generations. That program has been mucked up in politics and unions. At one time liberals detested how migrant farmers were treated and now they fight for more to treat them as bad. An inconvenient hypocrisy. Moreover, the south made the same argument to defend slavery. Let's not forget the Chinese immigration labor that built our railroads - great success, but doesn't make it right. The only difference is migrant farm workers are paid, but most often illegally, pathetic substandard, and not enough to be taxpayers. To defend that position would be to defend de facto slavery. I won't support that except I'm forced to when I buy produce (much of which now comes cheaper from Central and South America.

  • They come here for a better life!  Doesn't matter why - it matters how. If I robbed a bank for a better life, it doesn't make it right and my family would be fractured.  Moreover, legal immigration is about making a better life.  Those arguments only about illegal immigration are emotional, not practical or realistic. We can and do continue to profess the greatness of our great Country. A country of laws for a reason. Should we be the only open border country (essentially, that is the goal)? Legal. Illegal. Its one or the other, can't be both. If you had to look at both families and decide on one right now - what would it be? Three choices: Can't decide because its emotional. Decide based on emotion. Decide based on reality. But, you HAVE to decide on one of two, only one.

  • The children want to go to college!  The children born here are citizens - they have a right to college.  Those not here legally have no legal privileges and no college tuition breaks. DREAM and DACA are bogus. Their parents do not have a right to stay. Call me heartless - but when parents come here for their children to be born, knowing the potential consequences, that's not my issue. We incarcerate criminals every day that break up families. That argument may not be agreeable, but its factual. We only have two choices - support illegal activity or legal activity; you can't have both. My only position is I am more concerned about our citizens and legal resident aliens. When you let emotions get in the way, it clouds the ability to target the problem and devise a solution. Its how we got in this. This administration is now flying in children from Mexico and El Salvador – illegally (before the new unlawful executive orders – but in preparation for them)! Next, under this illegal presidential action, will be allowing their parents in so that families stay together. Absolutely wrong to pacify their choice and their consequences. I'm not heartless, just realistic.

  • The president had to act because Congress wouldn’t!  First, it is not the Constitutional duty – or authority – for the president to legislatively act in the absence of action by Congress. I recall that a full democratic Congress did not introduce an immigration bill - the Senate waiting to do so until they lost the House majority. Regardless - inexcusable to make and amend law contrary to our Constitution...its the very reason we have on, three branches, and checks & balances. Let's not bring up what all both Pelosi and Reid blocked and pushed over the years - its all politics, regardless of party (and there is no longer much of a difference). They even ignored a bill that had Ted Cruz, John McCain and Lindsay Graham on board with Chuck Schumer. Its a game. CDC functions regardless of any shutdown (which would be ignorant) and the last announcement was ebola was gone - then some guy died of it. However, Cruz and Montenegro have a point - they are from or are legal immigrants. Legal. I haven't figured out why no one wants to fix the problems of legal immigration in favor of illegal amnesty. That is simply ... time to be nice, but I have nothing nice to say about that thought process...except you can't have it both ways. I have one goal - fix legal immigration.

  • The children only want to go to college!  Non-sense – that is not why illegal immigration is a problem.  Its an emotional answer to a problem that almost exists.  Many children want to go to college -- we need not push on group aside for the benefit of another. Just like legal immigration reform or illegal immigration amnesty - you can support one or the other, but not both - who is the priority? Remove the emotion and work on a legitimate solution. Don't look for a problem to fix, it creates more problems. This is a good example of that - amnesty over the years has created this new problem of college education. Problem solved by saying no awards for illegal activity. I know - the children are victims, not players. Well, their parents knew and will know. Don't award their bad decisions. This is emotional vote pandering complicated by social issues that are the product of historically bad decisions for -- vote pandering and social issues. Its a vicious circle that is stopped by taking decisive action.

FYI - it is illegal for a person here illegally to receive any public assistance benefits (i.e. food stamps, housing, etc.). However, once the president signed his executive order, and Congress continues to fail to do their jobs, those persons will immediately be eligible for benefits.  We have homeless, veterans and families that are begging for assistance and being delayed or denied.

This is not solely resting on the president. Let us not forget that Congress has long encouraged or let him get away with these actions.  It is also yet to be seen who will actually go through the whole criminal background check, fines and taxes things.  It should also be reminded that, historically, both Congress and the president have acted wrongly and in ways that are counter-productive to enforcing the illegal immigration issue and fixing the legal immigration issue.

Fix the system for those trying to work with it, and not for those knowingly working against it.

The Race Card is Divisive
I’m a 7th generation native of Fort Collins, CO.  As a city, a mid-size town in my youth, it has always been an example of what other cities should endeavor to be.  We have been in 37 states and truly Fort Collins is a great place.  Until you get into the social issues.  Social issues are divisive because they are personal issues, not issues of government.  Social issues become the agenda of special interest groups and activists.  These do not further the interests, public health, public safety or economy of any locality.  In my book at, Beers with our Founding Fathers, this is discussed in specific detail in various chapters, connecting the cause and effect of social issues.  Please take a look at the website and previews at www.BeersWithOurFoundingFathers.com.

Racism.  It’s a word that is over used, albeit mostly with the best of intentions.  Racism exists and it always will.  Just like rape, murder, shoplifting and fraud – racism is perpetuated by human nature.  Much of what we see in racism is environmental and in groups, much less than seen in individuals.  A little racism in an individual grows exponentially in groups.  I could cite various examples just from our travels.  Racism knows no limits.  Racism – more accurately prejudice – is blind to race, sex, religion, sexual preference, intellect or any other personal traits for which a person is born.  Unfortunately, if a person or group has an agenda or feels wronged – the race card is played before the information and facts play out.  Assumptions that are actually based more on intrapersonal racism than that of their new target.  Racism is bi-directional – there is no ‘reverse’ discrimination.  Moreover, racism has been perpetuated by many asserting to rid of it, while others have created further racism through efforts to eliminate it.  Our history is filled with racism – that cannot be changed, it’s a sad and painful period of our history.  To pretend we, as a country and society, have not made great strides and gains is to be either blind, ignorant or racist.  Its really as simple as that.

So, what was the impetus for this blog?  A restaurant’s name.  Not just any name – but one with the dreaded ‘I’ word in it – ILLEGAL; specifically, ‘Illegal Name’ (sorry, not plugging a restaurant – it is the owner’s first name).  This is not new.  In the much more socialist – or so we thought – Boulder, just south, there are not one, or two – but five of these so named restaurants, founded in 1996 – 18 years ago.  No one has complained…ever…about the name.  But, now that he wants to open a restaurant in the open-minded Fort Collins, he faces resistance and demands to change the name.  I hope he does not cave in.  Who are the people primarily protesting?  Activists who are offended for those victimized by the name and the blanket inference in the use of the ‘I’ word as racist.  Illegal is not racist, nor is its use.  I’ll save detailing the full history of the restaurant and name.  His menu consists of ethnic food from the Mission District of San Francisco – Mexican.  I love Mexican food!  The claim is the Mission District is hispanic.  True, it has a deep historical culture and ancestry from Mexico – it was part of Mexico.  However, I have a relative that lives in the district and happened to speak to him after this.  The district has changed over the years and is presently better known for the gay and lesbian culture.  On social networks were some varied discussions of this – some surprised me, such as a liberal calling this a bullying tactic by the activists, and another liberal being ‘offended for those that live south of our border’.  It went on, and had I known this blog was going to happen, I would have copied some of his more pointless quotes before the host deleted them – The activist simply would not provide a basis for his position, other than he was offended for a group of people.  As we often see – those demanding tolerance have none.

You cannot be offended for someone – only yourself, and those you are related to or part of as a common group.  You cannot be offended solely based on an agenda and being an activist.  Bluntly, a white person cannot be offended for a person of a different race in a different city or state.  None of this is to say you are not offended.  It is to simply say you do not have standing to be offended as if part of the protected class (side note – ‘protected’ is also overused, we are all equal; but, I understand the usage).  To be offended for someone is to imply they are not capable of recognizing when they are offended.  In a free market economy, I firmly believe that a business can thrive or fail on its own by the decisions and actions of its proprietors.  There is now that social agenda line of forcing someone to serve against their personal beliefs.  Refusing service is not the same as a business name.  Should a business be able to refuse service to someone?  Perhaps to display their ignorance and failure, sure.  Sort of a public service announcement exposing those with prejudices.  Then you have someone protecting their own protected beliefs, such as religion.  How does that play out – when both sides of an issue have legitimate protections?  I think that is an individual choice.  Right or wrong, its not prejudice such as we see in outright racism.  Succinctly, they are both protected classes, and one cannot be prejudiced against to protect another.  A conundrum, for sure.  This is not the same as the days before the Civil Rights Era, a defining period in our Country.  At that time it was one protected class being refused, or segregated, based solely on their race; there was no inclusion of another protected class – such as religion.  In the former you have a business refusing service based on a customer’s race; and in the latter you have a business refusing service based on their religious belief that does not recognize a person’s sexual preference.  There are only three choices (operative word – choices):  1) the business refuses to serve the customer; 2) the customer refuses to patronize the business; or 3) differences are set aside because there is a mutual need and benefit.  Of course the common sense choice exists, but so does the individual choice of both.  Patronizing a business is a choice not born of necessity, whereas employment or housing are choices based on necessity.  Should choices be legislated and protected?  With both come unintended consequences.  If one does not wish the beliefs of another imposed upon them, then they should be conscious of their own actions.

I am a legal investigator and expert consultant by profession.  In my personal life I consider myself very open and welcoming, with boundaries but not prejudices.  My early childhood and background are varied in experiences and exposure.  We are not born with prejudices, but we do ‘learn’ them from childhood through life.  We learn, accept or reject our preferences and prejudices.  Its human nature, right or wrong.  Imagine our success if we accepted and rejected clients and assignments based on any criteria irrelevant to the case.  Imagine our reputation if we held any prejudices?  We would have declined cases from every (or almost) sex, race, religion, marital status, sexual preference, age, etc.  We would not have lasted 27 years, personally or professionally.  Similar to my disdain for prejudice, I am not in favor of preferences – including ‘reverse’ discrimination.

In our effort to create a utopia, we have further divided ourselves and our Country.  We have gone from a melting pot to a melted pot.  If we each made better decisions at a personal level there would be no need for rules and regulations of what are really choices – good or bad.  Our actions, as history has taught us, can be the impetus for positive change and better choices.

The restaurant in Fort Collins will likely open under its original and intended name.  It will face protests.  It will have customers.  People will choose to patronize, or not, the restaurant.  It will thrive or fail based on its ability to be part of the community.  Let us move forward with an open mind.
